Terms and Conditions

User License

You are granted a limited, personal, non-exclusive, non-assignable, and non-transferable license to access and use the Service for non-commercial, personal use only.  You acknowledge that by clicking on the “I Accept”, “Submit”, “Request Tutoring”, or similar button on the Learning Bridge website, you are indicating your intent to sign the relevant document or record and that this shall constitute your signature.

 

Limitation of Liability

In no event shall The Learning Bridge or its tutors be liable for any direct, indirect, incidental, special, consequential, punitive or exemplary damages. Damages for loss of goodwill, use of data or other intangible losses resulting from (i) the loss of data and/or the use or the inability to use the service; (ii) unauthorized access to or alteration of your transmissions or data; or (ii) any other matter relating to the service. In particular, but without limiting the generality of the foregoing, in relation to tutoring sessions, the Learning Bridge or its tutors makes no warranties or guarantees with respect to (A) the likelihood of success in a subject or class (B) or any that you will succeed in a subject or class. The Learning Bridge or its tutors shall not in any way be liable for your failure to achieve in any program.  

 

Disclaimer of Warranties

  1. Your use of the service is at your own risk. The service is provided on an “as is” and “as available” basis. You acknowledge and agree that no warranties of any kind, whether express or implied, are made by the Learning Bridge, and we expressly disclaim all warranties of any kind, whether express or implied.

  2. The Learning Bridge makes no warranties that (i) the service will meet your requirements; (ii) the service will be uninterrupted, available for any length of time, secure or error-free; (iii) the results that may be obtained from the use of the service will be accurate or reliable; (iv) the quality of any products, services information or other material obtained by you through the service will meet your expectations; and (v) any errors or defects in the service will be corrected.

  3. Any material uploaded/downloaded or otherwise obtained from the service is done at your own discretion and risk; the Learning Bridge is not liable, and you will be solely responsible, for any and all loss, or corruption, of data uploaded or inputted by you through the use of the service, and all servicing, repair, or correction and any damage that may result from the use of the service. 


Cancelling Tutoring Sessions

If you need to cancel a scheduled tutoring session, you must give the tutor 24 hours advance notice. If the tutor cancels or misses an appointment without 24 hours advance notice to you, you will receive one makeup session as soon as possible.


Adult Supervision

An adult must be in the vicinity of the online tutoring session if a video platform is chosen to be used unless the adult gives prior consent to an unsupervised session. 

 

Consent to Communication

a) Agreement to Receive Communications from the Learning Bridge. By using the website and providing your phone number and/or email on the Learning Bridge, you agree and acknowledge that the Learning Bridge may communicate with you via email, text messaging, text receipts, Short Messaging Service (“SMS”), facsimile, video calls and all phone calls at the number you provide. Such communications may be for any purpose, purposes related to Tutors and the Service provided to Tutors, and purposes related to Students and the Service provided to Students, using all methods now known and discovered in the future, including, but not limited to tutoring sessions, garnering of information, communication with parents and all other electronic communication. All video calls between tutors and students will be voice recorded by Learning Bridge Tutors and will be kept to be referred to on later dates. 

b) How to Withdraw Your Consent to Communications. You may acknowledge that you may withdraw such consent to communications by notifying the Company of such withdrawal) and repeating notification of such revocation if the Learning Bridge subsequently attempts further communication. 

 

Minors

This Service is not intended for use by children under 5 years of age, or Kindergarten. If you are under the age of 9, please do not provide your contact information or any other personally identifiable information to the Learning Bridge. If you are the parent or legal guardian of someone under the age of 9 who may have provided us with information without your knowledge or consent, please contact us to have this information removed. All contact, including tutoring sessions, between a tutor and any minor should, of course, take place only in a supervised setting. (see the section on adult supervision) 

 

Tutor Satisfaction

If you are not satisfied with the tutor we have assigned to you, please contact The Learning Bridge before your second tutoring session. We will assign a new tutor as soon as possible. 

 

Terms and Condition Changes

The Learning Bridge reserves the right to change these terms and conditions, from time to time, due to modifications to the organization's features and functionality. We will post any changes here and indicate the new effective date of the terms and conditions at the top of the document. We encourage you to review the Privacy Policy for any updates while you are an active user of the Site, as we will not notify you of any new changes, however, they still apply.

Governing Law Clause 

This agreement and the rights and obligation of the parties under this agreement shall be governed by, and construed and interpreted in accordance with, the law of the province of British Columbia.
